Superyacht berthed in European port under Maltese flag

Malta currently holds the distinction of administering the largest merchant flag in Europe and the sixth largest globally. Over the last decade, Transport Malta’s Merchant Shipping Directorate has established a specialized Commercial Yacht Code (CYC) tailored specifically to superyachts exceeding 24 metres in length.

1. Strategic Advantages of the Maltese Ship Registry

The Maltese flag is a European Union flag recognized on the White List of the Paris MOU and Tokyo MOU. This guarantees unhindered navigation and minimal port state control detentions across Mediterranean and international waters.

2. Tax Efficiency & Commercial Leasing Structures

Malta provides transparent financial mechanisms for commercial yacht operators:

  • VAT Minimization: Reduced effective VAT rates on commercial charters based on calculated time spent in international EU and non-EU waters.
  • Exemption from Income Tax: Income derived from the operation of commercial superyachts owned by Maltese shipping organizations is exempt from Maltese income tax.
  • Duty-Free Fuel Bunkering: Commercial yachts registered under the Maltese flag qualify for duty-free bunkering when departing on international voyages.

3. The Malta Commercial Yacht Code 2020 (CYC)

Unlike traditional commercial shipping frameworks, Malta’s Commercial Yacht Code addresses the specific realities of superyachts, balancing safety standards with luxury interior finishes and custom hull designs.

4. Streamlined Registration Procedure

Maltese law allows provisional registration within 24 hours of documentation submission, providing immediate operational authorization while formal survey clearances are finalized.
