By accessing and utilizing curivoquest.yachts, engaging Curivoquest Maritime Ltd. for superyacht brokerages, or booking berth reservations in Maltese waters, you agree to comply with these binding Terms of Service.
All yacht charters executed through Curivoquest are subject to standard Mediterranean Yacht Brokers Association (MYBA) terms or Mediterranean Charter Agreements (MCA). Charter rates include vessel hire, insurance, and crew wages, but exclude Advanced Provisioning Allowance (APA), VAT, harbor dues, and custom provisioning requests unless explicitly written.
An APA fee (typically 30% to 35% of the total charter fee) is collected prior to embarkation to cover fuel, berthing fees, food, beverages, and external port charges. The Master retains full financial records of APA expenses, and any unspent balance is returned in cash or bank transfer at disembarkation.
The Master (Captain) of the vessel retains absolute authority regarding navigation, weather decisions, itinerary modifications, and guest safety. If weather conditions prevent anchoring in open waters, the Master reserves the right to seek safe refuge in protected harbors without liability for itinerary changes.
These terms shall be governed by and construed in accordance with the laws of the Republic of Malta. Any disputes arising hereunder shall fall under the exclusive jurisdiction of the Courts of Malta.
